I should add that you can only port once your I-140 has been approved.
As per Yates memo, one can switch after 180 days even though I-140 was pending.

We have done FP thrice and they took finger prints of tips (the top 1/3 ) of th fingers. They did not took finger prints of whole hand. But for us they took finger prints of both left and right hand fingers.
Hello,
i feel down recently and i scraped my hand on the concrete, and i am worried about finger printing which i have soon. My palm is scratched mostly and smy fingers on my left hand are also scratched, most of my right hand is okay but there are some scratches too.
Do they take prints of the whole hand or just the index finger?

Hi,
Need some help/advice on PERM LC issue:
My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters or Bachelors with 5 Yrs experience),
On may'09 got a query saying "Discrepency in Alien education and experience".
Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.
my emplyer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"
my question: 1) Can this be considered as an error from the procesing center rather than my empr fault.
2) How severe this would be and what ud be the turn-over-time.
3) Do I need to reapply my PERM LC again.

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more

Yeah, right, first u need to find out which 140 was withdrawn. If the approved one is withdrawn, u r safe based on the fact that the same 140 was used with 485.

I have been trying to go thru various threads in this sub-forum. I have few questions, which I will appreciate if anyone can answer:
1. Are you responsible for invoking the AC21 or the new company that hires you does that?
2. Will you be hired into new company using EAD or H1B?
3. Does H1B need to be transferred to the new company anyways?
4. If wife has started using her EAD, how does that get affected?
5. Can you continue to use the AP issued or do you have to have a new AP re-issued?

Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
The DOL introduced a new Prevailing Wage system which will centralize everything. Previously each State's Workforce Agency gave those Prevailing Wage. Obviously there were discrepancies in how each SWA operated causing problems with DOL filings.
However, DOL introduced this new system of centralized Prevailing Wage determination with no computerized system of filing. We have to mail in our request to the DOL. Then the DOL will take forever to come up with a Prevailing Wage. The DOL has advised employers to file the Prevailing Wage 60 days prior to advertising for a PERM, since the ads expire in 6 months. This is strange because the DOL went computerized much earlier than the CIS did. Why could they not have a faster computerized process BEFORE centralizing the whole process? Was this then intentional?
This will slow down businesses, and filing of immigration. Similarly in July of 2009 the DOL significantly slowed down the LCA filings for H-1Bs. Which makes me wonder if DOL is slowing down things as a protectionist measure which caters to socialism? Is this the death of free enterprise, and business at the speed of 21 Century? It was another Democratic President and Congress that passed the AC 21 to speed the process up about a decade ago.

if your LLC is sponsoring your GC petition, then it is not possible. Your EAD will have certain conditions for employment, usually in the same line of work as the Labor Cert. Unless of course if you are a dependant EAD, then there are no restrictions on your employment opportunities.

In the US, attorney ethics rules vary somewhat from state to state. In most states, you are clearly entitled to all substantive materials contained in your case file. Unless the retainer/fee agreement clearly obligates you to pay for copying costs in this circumstance, the law firm should give you the documents you want without charge.
I think it costs as much as new application.
