I have my I 140 approved long time back--Dec 2006 (I dont know which service center). So it was not concurrent filing.
If that's the case why people in this forum are so concerned about Texas SC. By that nobody on July 2nd should have filed to Texas, unless he/she is doing concurrent!

Hello all:
Applied for 140 transfer TSC June 2007. Have not heard anything since, I mean absolutely nothing. Is this due to the backlog?? I am starting to get worried as I checked my status and all it says is, the received date and that when there is update they will let us know.
Did any of you apply 140 transfer in TSC around that time? Any news on those? Any case that it could've been lost?
Big question to the experts is, what do I do to make sure they are working on it and my application is in queue.

Hello All,
I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
The I-40 is approved but me and my wife�s I-485 is still pending.
We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.
My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.
Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

Perhaps you may be right. I have not digged that much ....But I will go through that in detail..
Some respectable names in the members list...
I donot think that these people are directly responsible for creating the issue in the first place....It is a reactive response to the anti-immigrant postures of many candidates...Also people like are us are not eligible to donate to immigrantList...Only citizens or premanant residents can contribute to immigrantList.....

Hi,
I am in desperate need of answer to my question and good thing I found this forum.
I have a boyfriend who was a refugee and so he has a special case green card that doesn't expire. He was 2 yrs. old when he came here but never thought about applying for citizenship. Last year, we decided to go to Philippines this Feb 2011 due to a friend's wedding and vacation. He couldn't apply for passport since he was born in a refugee camp and so he doesn't have a birth certificate. He decided to apply for a I 131 on August. According to the I 797 that he received, received date was Aug. 30, 2010, notice date was Sept. 1, 2010. Since we were expecting to receive the I 131 before our travel date (feb 4th to be exact), we decided to buy the tickets last month (december). He's been calling USCIS about his status and yet, he got the same response as to what is posted when he checks his status online "accepted" which is not very helpful. He asked the customer service rep if he can expedite it and they said, they can't do anything about it. It's very frustrating that we can't get hold of anyone who's really working on his paper. Then somebody told us to try Infopass. He scheduled it today but the earliest date is on Jan. 21st which is like 2 weeks after our scheduled departure. Will that be enough time for them to process it just in case they will just gonna process it by then?
My other questions are, can Infopass help him with his problem? Can they release his I 131 or refugee travel document by the time of his appointment? According to their processing time, it should take them 3 months and it's been more than 3 months, can we travel without a travel document and without a passport? This is very frustrating and stressful... Your response is very much appreciated..

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

AILA has reported a very interesting or confusing DOS LegalNet Office letter which one of the members received towards the fact that the consular posts had already been allocated their numbers for the month of July prior to EB visa numbers becoming unavailable on July 2 and that the posts may continue to use their July allocations of EB numbers, and continue to issue Immigrant Visas for the rest of this month, July, for those applicants who were scheduled for IV interviews in July. Hm.....................................
It thus appears that those who are scheduled for IV interviews should keep the schedule of interviews in July regardless of the current Visa BullEtin fiasco. Readers may also ignore our previous message on the consular processing. It is an extremely confusing time. Please check the visa interview appointment letters from your American consulate. Please stay tuned to this website for further information on the IV consular processing.

Changing your address using AR-11 does not affect any existing petition. To change your address on any outstanding application you need to call the USCIS customer service number. So relax, this has no effect on your application.

I am currently on OPT (Optional Practical Period) which is one year work authorization after completing my masters degree which started in Fed 2010 and valid for one year, and I got married to a US citizen in June 2010 (she is a born US citizen) and we applied for neutralization and our interview was scheduled in Oct 2010, But the thing is my wife was hiding one fact that she was married before and was divorced in 1999 She did not told me this until the interview was schedule with the fear of loosing me as she lied to me from the beginning when we first meet back in Aug 2007 and she continued with same lie with the fear of loosing me if she tells me the truth and assuming I will never find out about it, but later after the immigration interview was scheduled she told me the truth thinking something might go wrong and could land me in trouble and we went to court to get the divorce papers surprisingly the divorce was not finalized and after doing the paper work the divorce is now finalized.
Since we applied for immigration when her first marriage divorce was not finalized our application becomes invalid so we withdraw our application and we received an acknowledgement for the same.
Now that our marriage is valid and can apply for it again, but now my questions are.....
1. I don�t understand what is my current status? Am I still considered as a student? Shall I apply for H1B Visa in premium process as my OPT expired in Feb 2011?
2. Can I continue to be a Foreign Student (F1 Visa Status) after my OPT expired in Feb 2011.
3. Shall I reapply for Change of Status again with new application? With new papers??
4. While I was a student I worked on Cash is that going to be a problem for me??
Please Advise, and let me know If there any questions related to the above case.

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.

Is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?
I have changed my employment after I-140 approved. But the previous employer agreed to continue the GC process. I could not file 485 due to PD is not current.
The 6 yrs limit on H1 is about to be over.
Is it possible to extend H1-B after 6 yrs at the new employer, based on the I-140 approved by previous employer as green card is process? Or is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?

In order to extend H1B beyond six years, you do not require to be with the GC sponsoring employer. One must have filed a labor 365 days before 6th year end date. 1 or 3 years extension is based on what stage of GC processing you are in. Hope this helps!
