I tried to find the thread posted by PAPPU on ability to pay. Could some one help me with this?
PAPPU:long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
2. what are the consequences of using AP within 180 days after filing for 485 ?
3. Is AP and AC21 related ? [brother, sister , cousin :) ]

My in-laws got their visa at new delhi consulate on friday. they had appointment in english at new delhi. I had been looking for hindi appt dates at new delhi since june mid every day for 6-7 hours at morning and evening but could not get any hindi dates. Finally, had to book english dates on july 23 for july 30 appointment. here is my in-laws' experience:
first, they had a VO who asked them qs in english with accent. they were not able to understand a thing, so they requested him to ask qs in hindi after which he asked them to go to another counter where a young guy asked them qs in hindi. he was very polite and smiling all the time.
VO: Show me ur daughter's visa
we did not send them my wife's visa since i was sponsoring them.
Dad: We do not have daughter's visa. Here is son-in-law's visa
VO looked at the visa (I-797 and visa stamp copy), checked in computer for 4-5 mins and then asked
VO: Was it an arranged marriage?
Dad: Yes
VO: Tell me more about the process.
Dad: It was arranged marriage. My son-in-law's parents contacted us and then the girl and boy met each other and .....he described the process of arranged marriage.
VO smiled and asked: What do you do?
Dad: I am a businessman.
VO: What kind of business you do?
Dad told about his business
VO: Aapka Visa Manzoor ho gaya hai (Your visa has been approved).

I agree with you that you need to go with lawyers who are really specialized in immigration especially when the case is complicated.
I know a person whos company lawyer screwed up the case. (They are from a very reputed law firm). Then she went with Murthy, they did a great job and got it done for her. They charged her a lot but it was worth it.
So get the best out there. It may be expensive but if it fixes your case its worth it.

I got hold of a copy of the actual RFE and when I read closely, the above statement sounded alarming. Since the labor was filed in 2003, I was wondering what relevance June 26, 2006 has.

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all)
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?
EB2, if your I-140 approval reads as "Section: Mem of Profession w/Adv Deg, or of Exceptn'l Ability Sec.203(b) (2)" You should be worried only if you had two different 140 with the same employer. Take infopass and give a try, there is no standard procedure to find out.

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.

He has a 6 years of post qualification experience in india (after ca and ) and now he has 6.5 years of experience in US. (Total post qualification experience is 11-12 years)
His lawyer said as this is a 3 years degree you dont qualify for EB2. lawyer also send us a case where DOL denied CA plus 3 years of bcom under EB2.
Can you help us if he qualify for EB-2, what is the best way to file.

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?
This web site was being used to check cases from Philly and Dallas backlog centers ..read carefully
"The backlog public disclosure system only accepts Case Numbers beginning with either a D or P. Please enter the case number with all dashes. Where the # represents a number

I also have same question. DO we need to send COS. I heard that after getting receipt one is authorized to stay in US. I might be wrong. Please reply if anyone thinks differently..
