Hi
I lost my job in January and since I was not able to get a new project. So, returned back to India in May'09. My AP was valid till 21-July-2009. I did not file for extension while in US.
Now, I am getting a job in US and the employer is asking if I could join immdiately. Please let me know:
1. If there is any option for me to renew my AP from India?
2. Any other options, since my H1B got expired (6 years) in May'09.
Note: My EAD is valid till June 2010.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.
That's wonderful news and thank you for that. Is there a benefit of getting a 1-94 upto the extended date, does 1-94 determine the visa validity not the actual visa stamp? Since I-94 is taken when exiting US the next entry requires visa stamp anyway?

I have filed I-485 as derivative on my spouse case with his PD of EB3 Dec2005 as his I-140 was also approved in july 2007. I have AP/EAD through it, but have never used them.
I am currently on H1B and just got my I-140 approved through my employer in EB2. My priority is Feb 2005 which is much earlier than his EB3 Dec 2005. The approved I140 has the same Alien # that I received through my pending AOS case filed earlier in july 2007..
Do you recommend filing I-485 again based on August bulletin now that my PD is current.
How does processing date working in tandem with Priority Date.
What is your take on multiple I-485 filing.
Another option will be utilize consular processing with your approved I-140 especially with your current PD.
You may not need to file another I-485. If you applied through lawyer -- ask your lawyer to interfile your and your spouse's I-485 with your approved EB2 I-140. It will save you time and money.

My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.
What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??
Your friend and his co-worker has to find another job in same/similar field as soon as possible and file AC21 with the new employer.

Got an RFE to produce employment verification letter from my current employer. Yes, i changed the employer recently but didn't file AC-21.
Do you know how long USCIS takes to update the status online?

I am assuming that your lawyer sent it by some means that can verify that it was delivered.
USCIS usually takes about 7-10 days to update it online. (for example, if your RFE response was delivered to USCIS on Aug 10, expect it to be updated around Aug 17-20).
If you do not see update after 15 days of the delivery of the RFE response, call USCIS customer service so they can track it for you.

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)
No employer will write a direct agreement, you will have to payback the GC cost - instead they execute an agreement, employee should payback all the benefits (legal fees, service fee, tuition fee and etc)extended to him, if s/he leaves before X number of months/years - which is legal. I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

Thank you so much. I am much relieved now. So, As long as I work for the sponsoring employer(even though the labor location is different) is it ok to file Ac-21 and move to another employer.? My impression was that I was obliged to work for that exact position(the one on the labor) to prove the 'intent'.

If you have a job, getting a work permit will take only 4 hrs inside the consulate. No line. Give the passport and come back within 4 hrs to collect it.
No labor certification for computer(s/w for sure, dunno about h/w side for sure) professionals or petition. Need to show offer letter from the company and letter from company to the consulate.
1. Post on canadian job sites with local canadian address
2. get an interview call, canadian employers do not do interviews over phone like in the US. They ask for personal appearances.
3. If you land the job get an offer letter
4. Take the offer letter to the CCanadian embassy and get a work visa.
5. Once you enter Canada apply for Permanent residency.
